Acting in accordance with Art. 8 (1)(1) of the Act on Providing Services by Electronic Means of 18 July 2002 (uniform text Journal of Laws 2019, item 123) the following parties issue the following terms and conditions:

Dorota Rzążewska, conducting economic activity as JWP Kancelaria Prawna Dorota Rzążewska (address: ul. Żelazna 28/30, 00-833 Warszawa) NIP: 521 127 64 11, REGON: 012877745 (attorney at law at the Regional Chamber of Attorneys at Law in Warsaw, registered under number WA-3467 and operating in accordance with the Ethical Code of Legal Counsellors published as an Appendix to Resolution 3/2014 of the National Extraordinary Convention of Legal Counsellors held on 22 November 2014, available at www.kirp.pl in the part regarding the ethics and professional conduct of legal counsellors; and patent attorney acting in accordance with the Rules of Professional Ethics for Patent Attorneys adapted in its consolidated version as Resolution no. 7 of the National Extraordinary Convention of Patent Attorneys held on 12 January 2011, available at www.rzecznikpatentowy.org.pl in its part containing legal acts);

hereinafter jointly referred to as “Service Providers” or “the JWP Group,” with these terms understood as both entities together or separately, or in any configuration of the two of them,
hereby set out the following terms and conditions for providing services by electronic means (hereinafter referred to as “the Terms and Conditions”).
I General provisions
1. The Terms and Conditions are available free of charge at jwp.pl in the section containing terms and conditions for providing services in a form allowing their acquisition, reproduction, recording, and printing.
2. The following terms used in the Terms and Conditions shall have the meaning set out alongside them hereinbelow:
- JWP Online – a website available on an internet server at online.jwp.pl, which is a set of static and dynamic documents containing graphical files, scripts, and other elements of the set, connected by mutual relations, whose purposes include data sharing and sending information and files by the User to the Service Providers;
- the Newsletter Service – a service whereby the Service Providers send messages containing information on intellectual property and action taken by the members of the JWP Group to an email address provided by the Client;
- User – a natural person having the capacity to conduct legal activities who uses JWP Online or the Newsletter Service, or a legal person or an organizational unit without the status of a legal person who is granted legal capacity by law, represented by a natural person.
3. It is prohibited for Users having access to JWP Online to send information and content which is illegal, offensive, indecent, untrue, and/or misleading, as well as any content containing viruses or capable of causing disruptions or damage to computer systems.
4. The JWP Group does not guarantee continuous operationality and accessibility of JWP Online’s various functionalities. Limited accessibility or disruptions in the functioning of JWP Online may be caused by e.g. force majeure or the necessity to carry out technical work.
5. JWP Group reserves the right to close JWP Online and discontinue the Newsletter Service at any time. The User shall not be entitled to any claims arising from the exercise of this right by the JWP Group.
6. The User should immediately inform the Service Providers about any security breaches by sending an e-mail to dane@jwp.pl.
II Using JWP Online
1. Using JWP Online is free of charge.
2. JWP Online is a website where, upon logging in, the User obtains access to data, documents, and information on matters conducted on their behalf by the Service Providers. JWP Online does not constitute an official data filing system and cannot be a substitute for it, and therefore the information and documents contained therein are not legally binding.
3. Users can use JWP Online twenty-four hours a day.
4. User Accounts are created by the Service Providers in agreement with the User. In order to create an account, the User provides the Service Providers with an e-mail address.
5. Users can change their passwords by themselves.
6. To log into JWP Online, users must provide their login and password details every time.
7. The User may at any time, without the need to indicate the reason, request the deletion of their account by sending a message containing a suitable request to dane@jwp.pl. The request to delete the account, as well as other services described in these regulations, are free of charge.
8. At any time, and particularly in the case of:
- violation of these Terms and Conditions or other legal regulations by the User,
- the Service Provider having reasonable grounds to believe that it is necessary to protect the safety of Service Providers, Users or third parties,
- for the purposes of any open investigations,
Service Providers reserve the right to temporarily or permanently restrict access or permanently deny access to JWP Online.
9. The User shall not be entitled to any claims arising from the exercise of the rights defined in the above paragraph by the Service Providers.
III Using the Newsletter Service
1. The Newsletter Service is free of charge.
2. The Newsletter Service is available to all Users who provide their e-mail address, name, and surname at www.jwp.pl in the section concerning the Newsletter Service and consent to the use of their personal data by the Service Providers for the purpose of sending the Newsletter, as well as consent to receiving commercial information which the Newsletter may contain, and who have read the information on the processing of personal data.
3. The Service Providers make decisions on the content and frequency of messages sent as part of the Newsletter Service.
4. The User may, at any time and without the need to pay additional charges or to indicate the reason, discontinue to use the Newsletter Service, by clicking on a hyperlink contained at the end of every message, if such hyperlink is included, or by sending a message with a suitable request to dane@jwp.pl.
5. At any time, and particularly in the case of:
- violation of these Terms and Conditions or other legal regulations by the User,
- Service Provider having reasonable grounds to believe that it is necessary to protect the safety of Service Providers, Users, or third parties,
- for the purposes of any open investigations,
the Service Providers reserve the right to temporarily suspend or discontinue the Newsletter Service.
6. The User shall not be entitled to any claims arising from the exercise of the rights defined in the above paragraph by the Service Providers.
IV Technical conditions
1. To use JWP Online or the Newsletter Service, the User shall meet the following technical conditions: having a computer or a mobile device with access to the Internet and one of the following updated online browsers: Chrome, Firefox, Safari, or Microsoft Edge.
2. In the case of the User using hardware and software which do not meet the technical requirements described herein, the Service Provider will not be responsible for the quality of the Services or the failure to provide them.
3. In order to ensure security of the Services provided and data transmitted, the Service Provider shall take steps, particularly of technical nature, adequate to the threat.
V Queries, comments, and complaints
1. The Users have the right to make queries, comments, and complaints regarding the provision of the Services.
2. Queries, comments, and complaints should be sent to dane@jwp.pl (with the word “complaint” in the title of the email).
3. Questions, comments, and complaints will be handled at the nearest possible date in an electronic form, not later than 30 working days from the date they were made.
4. The complaint shall contain at least the following:
- User’s ID data, e.g. first name and surname, email address;
- a description of the reason for the complaint and of the circumstances on which the complaint is based;
- a description of the User’s expectations.
VI Rules for processing personal data for the aim of providing access to JWP Online and for providing the Newsletter Service.
1. The rules for processing personal data for the aim of providing access to JWP Online and for providing the Newsletter Service are laid out in the document titled “Privacy Policy,” available at jwp.pl in the part containing provisions on the Privacy Policy.
VII Final provisions
1. The User shall bear the costs of using telecommunications services, including electronic means of communication, required for using the Services, according to the rates of the User’s telecommunications service provider.
2. JWP Online and the messages sent to the User as part of the Newsletter Service contain content protected by copyright and industrial property law, and intangible goods protected by the intellectual property law. None of such contents, in particular the text, photos, programs, graphics, trademarks, icons, logos, etc. presented on the website may be reproduced or distributed in any form or in any way without prior permission. The User undertakes to use the content published on JWP Online and received as part of the Newsletter Service only for permitted personal use.
3. The Service Provider shall immediately notify the User of any amendments to these Terms and Conditions by e-mail to the e-mail address provided by the User of JWP Online or the Newsletter Service.
4. These Terms and Conditions may be changed, e.g. in the case of:
- changes in the applicable legal regulations affecting the content of these Terms and Conditions;
- changes to the scope of the services provided;
- changes to the type of services provided;
- a change in technical requirements;
- a change related to extension of the functionalities of JWP Online or the Newsletter Service.
